Terms and Conditions Villa Aeglos Gennadi

Application
• These general terms and conditions apply to reservations and agreements regarding the villa “Villa Aeglos Gennadi” standing and located in Gennadi, Rhodes, Greece.
• In these general terms and conditions, the term “tenant” is understood to mean: the person who concludes a rental agreement with us regarding the rental of the villa.
• These general terms and conditions apply regardless of your (prior) reference to any of your own terms and conditions or to other general terms and conditions. We reject all general terms and conditions to which you refer or which are used by you.
• Agreements that deviate from these general terms and conditions are only valid if agreed in writing.

1. Reservations
a. We only accept reservations from persons who are 23 years of age or older.
b. Persons under 23 years of age can only check in in the presence of a parent or official guardian.
c. The landlord has the right to refuse a reservation due to the age or composition of the group of tenant(s) or because the landlord has grounds to assume that the tenant will not comply with the obligations under these general terms and conditions or will otherwise not behave as a good tenant.
d. After you have made a reservation and we have accepted the booking, you will receive written confirmation from us within five days.
e. An agreement is concluded between you and us at the moment that we have confirmed the reservation to you. The agreement concerns the rental of a villa for recreational use, which is by its nature of short duration.

2. Payment
a. The following conditions apply to payment:
i. Payments for the rent must be made by bank transfer;
ii. The tenant must have paid 100% of the total amount 30 days before the arrival date.
iii. In the event that the rental agreement is concluded within 30 days before the arrival date, the tenant must pay 100% of the total amount within 2 days after entering into the agreement.
iv. The deposit is €300 and must be paid in cash to the host during check-in on location.
v. All prices and costs are stated in euros (EUR) and must also be paid in euros (EUR).
b. Payments must be made by bank transfer to IBAN: …………. in the name of ………………. stating your first and last name and the period of your stay. Making a payment confirms that you have read these general terms and conditions and agree to them. The rental ends automatically after the agreed period has expired. In case of late payment, as described in article 2a, you will be in default immediately after the payment term has expired. In that case, we reserve the right to cancel your reservation and terminate the agreement.

3. Deposit
a. The tenant will be charged a deposit of €300,- which serves to guarantee damage and/or costs in the broadest sense of the word that we can withhold in the event of non-compliance with the obligations of the tenant and those accompanying the tenant.
b. The deposit must, as already described in article 2a, be paid in cash to the host during check-in.
c. In the event that the deposit is not paid, we are entitled to deny the tenant access to the villa. If you fail to pay the deposit, we are also entitled to terminate the agreement with immediate effect.
d. The deposit or any remainder thereof will be refunded in cash during check-out after settlement of any claims (e.g. damage to inventory/villa and/or other (cleaning) costs). Any (further) claim for compensation will not be nullified by us through this refund.
e. If, in the event of (any) damage, it appears that the deposit is not sufficient to cover the full damage, we reserve the right to hold you liable for the (remaining) damage.

4. Changes
a. If the tenant wishes to make changes to the booking after the booking/agreement has been concluded, we are not obliged to comply. It is at our discretion whether and to what extent changes are accepted. In principle, changes cannot be permitted within 30 days prior to arrival.
b. If the tenant wishes to change the period of stay to another or non-consecutive/adjacent period of stay after the booking/agreement has been concluded, the cancellation provisions as stated in article 5 apply. A different period of stay is in any case understood to mean a period that does not fall within the period of stay reserved by the tenant (and confirmed by the landlord).

5. Cancellation and/or amendment of the rental agreement by the landlord
a. The landlord can terminate or amend the rental agreement in the following cases:
i. If the tenant does not pay the rental price (on time);
ii. In the event of force majeure, unforeseen or unavoidable circumstances (strike, government measures, environmental and/or natural disaster, war, extraordinary weather conditions, fire, death of the landlord(s) or host).
iii. Due to circumstances that are of such a nature that renting out the villa becomes impossible, such as theft of inventory, vandalism of the villa and unauthorized admission of persons and/or causing nuisance. If this is attributable to the tenant, paid amounts for nights that have not yet elapsed will not be returned.
iv. The landlord is not liable for any damage suffered by the tenant as a result of the termination of the rental agreement.

6. Cancellation and/or modification of the rental agreement by the tenant
a. Cancellation by the tenant must always be done in writing (by e-mail (info@aeglosvillas.com)). The following conditions apply:
i. In case of cancellation up to 30 days before the day of arrival or in case of no-show, 100% of the rental amount is due.
ii. If the tenant leaves the villa before the end of the reserved period of stay, no refund will be made.

7. Receiving the key
a. The key will be handed over by the local host upon arrival at the location. The tenant is never entitled to duplicate the key for any reason whatsoever. Should the tenant do so, the tenant will owe a fine of €500, without prejudice to the actual costs. The key to the villa will be made available to the tenant by us on loan. The key remains our property. In the event of loss, theft or any other form of loss of the key, all locks in the villa will have to be replaced. The costs of this will be borne by the tenant.
b. All costs incurred because you do not return the villa on time will be recovered from you. We will store goods found after your departure for a reasonable period for you, but we do not accept any responsibility for this. Re-sending can only be done at your expense.
c. If the tenant and/or other users have locked themselves out of the villa, €50 will be charged for this. This will be offset against the refund of the deposit. For verification purposes, we ask the tenant to identify himself before the copy key is handed over.

8. Your stay in the villa
a. The tenant and other users must behave as good tenants during their stay in and around the house.
b. Check-in is possible from 16:00.
c. Check-out must take place before 11:00.
d. The villa is non-smoking. Smoking is allowed outside on the terrace.
e. The use of (soft or hard) drugs is not permitted.
f. No open fire is allowed outside.
g. Pets are not allowed, neither in the villa nor on the grounds.
h. Barbecuing with the barbecue provided is permitted (this must be left clean before leaving the villa). The use of water and electricity is included, but we kindly request that you use this sparingly.
i. The stay of more people in the villa than agreed (at the time of booking), or than the maximum of six people applicable to the villa, is expressly not permitted without our permission, unless otherwise agreed in writing. In the event of violation of this, additional costs will be charged. j. Subletting or subletting is strictly prohibited.
k. Parties are prohibited, due to noise nuisance for the neighbours. This may lead to the premature termination of the rental agreement on our part, without refund of the rental fees.
l. Moving cupboards and beds, as well as sound or television equipment or taking any part of the (indoor) inventory outside is strictly prohibited, with the exception of the crockery/glasses and cutlery for your meal outside.

9. Cleaning
a. The standard final cleaning is included in the rental price.
b. In case of serious pollution of the villa, the deposit (partly or in full) can be used to compensate for the extra cleaning costs incurred.
c. For a stay longer than seven nights, the villa will be cleaned once extra during the stay. The linen will also be replaced.
d. If an extra interim cleaning is desired, this must be indicated to the host Despina. The costs for this are €130,- and must be paid in cash to the host.

10. Force Majeure
a. Force majeure on our part exists if the execution of the agreement is prevented in whole or in part, temporarily or otherwise, by circumstances beyond our control, including the risk of war, strikes, blockades, fire, floods and other disruptions or events.

11. Liability/complaints/damage
a. The tenant and other users are fully and severally liable for all accidents and damage that occurred to the villa, the inventory and all items that belong to the rented object during the relevant rental period, unless the tenant and other users can demonstrate that the damage cannot be attributed to them. We therefore advise you to thoroughly inspect the inventory for defects upon arrival at the villa and if you notice any damage or defects, report this to us immediately.
b. Vandalism and/or damage caused by the tenant will be recovered from the tenant based on the costs of the new value.
c. We accept no liability for theft, loss or damage of or to items or persons, of whatever nature, during or as a result of the stay in the villa.
d. We accept no liability for construction activities on the (main) roads etc. in the vicinity of the villa.
e. The landlord is not liable for any inconvenience or loss of enjoyment of the rental property in the event that work is being carried out in the vicinity of the holiday home, such as road works or construction work or other activities.
f. We accept no liability for the failure or disabling of technical equipment, utilities, the failure or partial failure of the internet and/or the TV.
g. It is prohibited to download, upload or stream illegally. The tenant is responsible and liable for his/her own internet use and if fines are imposed, these will be passed on to the tenant. The personal details of the tenant/offender will be made known at the request of the authorities. All costs incurred by the landlord in connection with such an infringement will be recovered from the tenant.
h. We accept no liability for accidents.
i. The costs of normal maintenance and repair of defects are for our account. If defects occur, the tenant must inform us of this immediately and follow our instructions as much as possible.
j. The tenant will give the landlord sufficient opportunity and cooperation to resolve the complaint within a reasonable period of time. The landlord will make every effort to resolve the complaint as quickly as possible and to the satisfaction of the tenant. If the complaint cannot be resolved satisfactorily, the tenant must submit it to the landlord in writing and with reasons.
k. If you wish to submit a complaint, it must be submitted to us in writing and with reasons within 14 days of leaving the villa.

12. Departure
a. In case of incorrect use or incorrect leaving of the villa, additional (cleaning) costs may be charged to the tenant;
b. After the end of the stay, the tenant must:
c. Leave the house (swept) clean and tidy
d. Have washed everything clean, dried and put it back in the cupboard;
e. Beds must be stripped and the duvet covers and linen must be folded and placed in the hallway;
f. Leave the dishwasher and refrigerator clean and empty;
g. Take food with you and do not leave it in the cupboard(s) and/or refrigerator/freezer;
h. (Please) put the cushions of the garden furniture inside behind the sofa;
i. Have emptied the garbage bins. There are garbage bins for residual waste in the villa. There is a large garbage container outside on the yard and upon departure you deposit these garbage bags in the large garbage container. j. Any breakage and/or damage must be reported to the host Despina or to us via info@aeglosvillas.com;

13. No rights can be derived
No rights can be derived in any way from the information, prices, photos and images as stated on the website of Villa Aeglos Gennadi (www.aeglosvillas.com).

14. Applicable law
Op al onze voorwaarden en bepalingen uit de huurovereenkomst/huisregels als ook eventuele geschillen hieruit voortvloeiend, is uitsluitend het Nederlands recht van toepassing.
